General Terms and Conditions of Sale

Purpose and scope

These General Terms and Conditions of Sale, hereinafter referred to as the “GTC”, govern sales made on the site www.calmeras.com.

They apply to orders placed by customers for the products offered for sale on the site.

Any order implies acceptance of these GTC in their applicable version at the time the order is confirmed.

Definitions

In these GTC:

• CALMERAS means the brand and the online store.
• Customer means any person placing an order on the Site.
• Site means www.calmeras.com.
• Product means any item offered for sale on the Site.
• Order means a purchase confirmed by the Customer.

Products

The essential characteristics of the products are presented on their respective pages.

CALMERAS strives to provide descriptions, photographs and information that are as accurate as possible.

Slight differences may nevertheless appear, particularly with regard to colors, depending on the screen used and its settings, or the shooting conditions.

Characteristics such as material, size, color, and momme weight, where applicable, are specified directly on the relevant product page.

Product availability

Products are offered subject to the stock levels or availability indicated on the Site.

If a product becomes unavailable after an order has been confirmed, the Customer will be informed as soon as possible.

An appropriate solution may then be offered, in particular a new shipment when possible, an alternative accepted by the Customer or a refund.

Order

To place an order, the Customer selects the desired product or products, as well as any options offered, where applicable.

Before final confirmation, they are responsible for checking their cart, their delivery address, their contact details and payment information.

Final validation of the order entails an obligation to pay.

A confirmation is sent by email after the order has been registered.

CALMERAS may refuse or cancel an order when there is a legitimate reason to do so, particularly in the event of suspected fraud, manifestly incorrect information, or non-payment.

Prices

The applicable prices are those displayed on the Site when the order is confirmed.

Delivery costs and any other applicable charges are presented before final payment confirmation.

CALMERAS may change its prices at any time. However, a price change has no effect on an order that has already been definitively validated.

Payment

Payment is made using the solutions offered to the Customer when confirming the order.

The order is definitively validated only after payment has been accepted by the relevant service provider.

Transactions are processed using secure payment solutions. CALMERAS does not have direct access to the Customer's complete banking details.

Preparation and delivery

Orders are prepared before they are handed over to the carrier.

After dispatch, delivery times vary depending on the destination. The estimated delivery time is generally 2 to 5 business days.

These times refer to transit after dispatch and may exceptionally vary depending on the destination, the carrier, or circumstances beyond CALMERAS’s control.

Receipt of the order

Upon receipt of the order, the Customer is invited to check the condition of the package and the products received.

In the event of a damaged, incorrect, or missing item, the Customer is invited to contact customer service as soon as possible.

To facilitate processing, it is recommended to provide the order number and, where appropriate, photographs of the product and package.

Right of withdrawal

Where the right of withdrawal is applicable, the consumer has 14 days from receipt of the order to inform CALMERAS of their decision to withdraw.

The request may be made by contacting customer service and indicating the order number as well as the product or products concerned.

After notifying CALMERAS of their decision, the Customer must return the products within the time limits provided for by the applicable regulations.

This rule does not apply where a return results from an incorrect item, a non-conformity, a recognized defect, or an error attributable to CALMERAS.

Condition of returned products

The products must be returned complete and in a condition compatible with their inspection and their potential resale.

Any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and proper functioning of the product may be taken into account in accordance with the applicable regulations.

Exceptions to the right of withdrawal

The right of withdrawal may be excluded in the situations expressly provided for by law, in particular for certain personalized products or for certain unsealed goods which cannot be returned for reasons of hygiene or health protection, where the statutory conditions for this exception are met.

Refund

When a refund is due following the valid exercise of the right of withdrawal, it is made within the time limits provided for by applicable regulations.

The refund is made, except where otherwise permitted, using the same payment method as the one used for the initial order.

Where permitted by applicable regulations, CALMERAS may defer the refund until the products are recovered or until proof of their dispatch is provided.

Statutory warranties

The Customer benefits from the statutory warranties applicable to their purchase, in particular those concerning the conformity of the goods and any hidden defects, where these provisions apply.

These warranties apply independently of any commercial warranty that may be offered.

If a product has a defect or non-conformity, the Customer is invited to contact the customer service department with the order number and the information necessary to assess the request.

Liability

CALMERAS is liable for the performance of its obligations within the limits provided for under applicable regulations.

However, CALMERAS shall not be held liable where a failure to perform results from an act attributable to the Customer, an external event, or a circumstance recognized under applicable law.

No provision of these General Terms and Conditions deprives the consumer of any mandatory right to which they are legally entitled.

The personal data required for order processing, for delivery and customer relations are processed in accordance with applicable regulations.

Intellectual property

The content available on CALMERAS, including text, visuals, photographs, graphic elements, logos and visual identity, is protected by applicable intellectual property rules.

Any unauthorized reproduction or use may be prohibited in accordance with the applicable regulations.

Complaints and dispute resolution

In the event of a problem relating to an order, the Customer is invited to contact CALMERAS customer service in the first instance in order to seek an amicable solution.

Where the applicable regulations provide for a mandatory mechanism for mediation or alternative dispute resolution, the corresponding information is made available to the consumer in accordance with the applicable obligations.

Applicable law

These General Terms and Conditions of Sale are interpreted in accordance with the law applicable to the contractual relationship.

When a Customer acts as a consumer and benefits from mandatory provisions in their country of residence, these General Terms and Conditions of Sale may not have the effect of depriving them of the protections guaranteed by those provisions.
